A good friend of mine , who has now left Thailand headed back to the UK fulltime , has an issue with his condo block but doesn't know what to do. Some on here know who he is.
His condo is worth in excess of 35 million baht. I've been there and it's really a very nice penthouse condo to own. Personally I'd be happy just to live on his balcony. The rent is substantial in any currency.
The issue is with the pool. He's received notices requesting payments to the condo office to fix a structural issue that hasn't been discussed until now. He bought the condo perhaps 5 max years ago brand new. The requests of cash from him aren't small amounts.
According to the building management, the beams that support the pool aren't up to spec and therefore need replacing. This also means the carpark under the pool is closed. The tenant isn't happy about this. Their carpark is gone plus the pool is closed.
Pool issues have been ongoing for over 6 months now, the carpark only recently.
Where does he stand?

In the car park with water around his ankles? They're claiming the beams that support the pool aren't strong enough meaning the pool could collapse into the underground carpark. More than up to his ankles

I presume you are talking about the common pool, not one in his appartment. If it is in the common area a levy may I believe be made, but it must be the same percentage based on area for all condo owners. Not more for one.

Drain the pool. Put in some outdoor furniture and call it a beer garden. That should take 50 ton off the supports.

Reminds me of the eighties when those water beds were popular. Putting an extra ton of weight over a couple of house stumps and wondering why the house started sinking in one corner.

On a serious note though Hip. Re-engineering seems the only option. Extra posts in the carpark to test their driving skills. Unless of course, they are pulling his leg and attempting to extract a few extra baht. I would find it hard to believe it wasn't designed property in the first place.

An extra charge can be levied on all co-owners if agreed at an AGM. Co-owners with larger units will pay more as it is levied according to the ratio/per sqm. The other way is to use a part of the sinking fund (pun intended) which also needs to be agreed at an AGM. That would get the money quickly and then the sinking fund could be topped up again over an agreed period of time using annual special assessments. A major facility such as a pool being out of order and reduced parking will very quickly result in the value of the property falling dramatically. The structure of the condo must be guaranteed for 5 years by the developer. I assume that the management have checked this?

Hey hip. Which came first, the carpark or the pool? If he decided to brick in the carport roof and make a pool, of course it won't handle the weight.

Pool sits on top over part of the basement carpark. Thing is the pool has been an ongoing saga for a long time. At one stage the lights in the pool kept flickering on and off which was a concern being electricity in water. I'd guess the pool has been out of action for over a year total out of the last 3 or so years with various maintenance issues. I think the pool being concrete will be an issue replacing support beams. Major structural operation!
