You have to define illegal as being under criminal or civil codes, how many people do you know who have flogged a car to some one which the bank still owned and pocketed the cash who have gone to jail ?....i would wager very few or none, simply because the transaction to start with is a commerical  transaction, ie in a lot of countries rightly or wrongly its a civil case
