Bigger news than most non-Americans realize - ................................................................................. Antonin Scalia, the longest serving judge on the US Supreme Court, died in his sleep on Saturday at the age of 79 during a hunting trip. His body was found when he did not appear for breakfast at ranch in West Texas, according to local reports. Justice Scalia, who was appointed by Ronald Reagan in 1986, was one of four conservative judges on the nine-strong Supreme Court. He was the only child of a Sicilian college professor from New York and became the first Italian-American to be appointed to the court. He was a frequent source of frustration to liberals and last year issued a nine-page dissent when the court legalised same-sex marriage across the US, describing the majority decision as a “judicial Putsch” that posed a “threat to American democracy”. Let's think ahead,....... The candidate with the best chance might well be Lisa Madigan, whom the President knows from their time together in the Illinois legislature. Statewide elections in Illinois happen in 2014. Pat Quinn will certainly run for re-election as Governor of Illinois. There is an Illinois U.S. Senate seat up in 2014, but the incumbent Democrat Dick Durbin (who crushed his opponent in 2008) will presumably run again. So Madigan likely faces the prospect of running for and winning a fourth term as state attorney general, with no obvious path to higher office. ^^ Yup, interesting times. I remember the Clarence Thomas confiration being high drama - this time round, any proposed candidate by Obama is going to have the Republicans crawling all over them as they know the importance of these selections.

They are. One case I’m watching closely and the ramifications of a 4 – 4 split. First for those of you who don’t know,……. there is no majority for a decision and the lower court’s ruling stands, as if the Supreme Court had never heard the case. Because it is very unlikely that a replacement will be appointed this Term, we should expect to see a number of such cases in which the lower court’s decision is “affirmed by an equally divided Court.” The case,..... What Antonin Scalia's death means for Obama's climate plans Snip Industry groups and 27 states are currently suing to overturn the Clean Power Plan in court, arguing that the EPA overstepped its authority under the Clean Air Act to regulate CO2 in the way it did. That case is currently being heard by a three-judge panel of the DC Circuit Court. Oral arguments begin June 2. A decision is expected by fall. Right now, the Obama administration looks likely to prevail here. Two of the judges on that panel — Judith Rogers (a Clinton appointee) and Karen Henderson (a George H.W. Bush appointee) — have been sympathetic to environmental claims in the past. And the third judge, Sri Srinivasan, is a recent Obama appointee. So it's entirely plausible that the DC Circuit Court will uphold the Clean Power Plan. Snip So the survival of the Clean Power Plan isn't assured for all eternity. But the prognosis looks a lot better today than it did on Friday. I was reading the SCOTUS Blog and they think (with reasons) the Ninth Circuit Judge Paul Watford will most likely fill the empty seat. The Republicans should go with Obama's choice because Mrs. Clinton's (our next president) nominee might just frighten the hell out of them. Whoever President Obama nominates I am sure he/she will be a highly qualified liberal. I suggest that the redoubtable C.M.K. is the ideal character for the position. Didn't finish law school - I got drafted. Vietnam and Thailand in the late 1960's changed my life's direction. Not sure but I think finishing law school is a requirement to be on the Supreme Court.
